Acceptance
By creating a Hesett Pro account or otherwise using any Hesett product as a restaurant operator, you agree to these Terms and our Privacy Policy. If you sign on behalf of an organization, you confirm you have authority to bind that organization.
Definitions
- Hesett: Hesett Technologies Inc., a Delaware corporation, with operating presence in Bogotá, Colombia.
- Service: the Hesett Pro dashboard, partner mobile companion, smart devices, and the back-end services that power them.
- Partner: a restaurant, bar, or hospitality group using Hesett Pro to run service.
- Diner: a guest at a Partner's venue who interacts with the Hesett guest-facing apps.
Partner accounts
Each account belongs to one legal entity (a restaurant, group, or franchise). The signer accepts responsibility for everything that happens under the account. Add staff as separate users with role-based access — do not share credentials. Notify us immediately at support@hesett.com if you suspect compromise.
How you may use Hesett Pro
You may not, and may not permit anyone to:
- Use the Service for unlawful purposes, including fraud, sanctioned trade, or money laundering.
- Reverse-engineer, decompile, or copy any part of the Service, except where local law expressly permits.
- Resell, sublicense, or white-label the Service without a separate written agreement with Hesett.
- Submit false orders, manipulate payout flows, or use Hesett to settle non-restaurant transactions.
- Probe, attack, or stress-test production systems. Coordinated vulnerability reports are welcome — see our Security page.
Guest data as Processor
Where Hesett processes diner data on your behalf (order history, allergens, reservation details, loyalty), Hesett acts as a Processor and you remain the Controller. The Data Processing Agreement (DPA) you sign at onboarding governs this relationship, defines retention, audit, and breach-notification, and is incorporated into these Terms by reference.
Fees and payouts
Subscription fees are charged monthly or annually per the plan you select. Card payments to your venue are processed by Stripe and routed to your bank through Stripe Connect at the cadence you configure. Stripe's standard transaction fees apply (2.9% + 30¢ for most cards); Hesett does not take a per-order commission.
Refunds are issued from your funds (because the order was paid to you, not to Hesett). Hesett mediates refund disputes between you and the diner if needed.
Smart devices
Hesett-branded table buttons and staff smartwatches are sold or leased under a separate Hardware Addendum. Devices come with a 12-month limited warranty; firmware updates are provided over-the-air for the life of the product. On account termination, leased devices must be returned within 30 days.
Intellectual property
The Hesett name, logo, brand, and all platform code, designs, and documentation are owned by Hesett Technologies Inc. Your menu, photos, brand assets, and operational data remain yours; you grant Hesett a worldwide license to display, translate, and process them within the Service.
Liability
The Service is provided “as is.” To the maximum extent permitted by applicable law, Hesett Technologies Inc. is not liable for indirect, incidental, consequential, or punitive damages, including lost profits or lost revenue resulting from service interruptions, integration outages, or data incidents not caused by Hesett's gross negligence.
Our total aggregate liability for any claim arising under these Terms is capped at the greater of (a) the total subscription fees you paid Hesett in the 12 months preceding the event, or (b) US $5,000.
Termination
You can cancel any time from the dashboard. We can suspend or terminate accounts that violate these Terms, with notice where reasonable. On termination, you may export all your data in CSV / JSON for 90 days; after that we delete it (subject to legal retention).
Changes
We update these Terms occasionally. Material changes are announced at least 30 days in advance via email or in-dashboard banner. Continued use after the effective date constitutes acceptance.
Governing law
These Terms are governed by the laws of the State of Delaware, United States of America, without regard to conflict-of-laws principles. Disputes are submitted to the state or federal courts in Delaware, with carveouts for mandatory local consumer law in the Partner's jurisdiction.
